The SpywareShield Initiative, led by the Society for Civil Rights (Gesellschaft für Freiheitsrechte, GFF), is dedicated to tackling the growing threat of surveillance software across Europe. Spyware poses a severe risk to fundamental rights, press freedom, and democratic institutions, enabling governments and private actors to monitor activists, journalists, and political figures without accountability. Our mission is clear: to limit the deployment of spyware, prevent its proliferation, and strengthen digital security across the European Union. Through strategic litigation, policy work, and collaborative partnerships, we work to challenge the use of spyware in courts, push for legislative reforms, and empower civil society organizations to take action.

Our Approach

Through Legal Action & Advocacy, we challenge laws before national and European courts, holding governments and companies accountable for surveillance abuses. On a policy level we push for regulatory measures at the European Union (EU) and national levels, advocating for a ban on commercial spyware and stronger privacy protections. Collaboration and working with partner organizations is essential to amplify our efforts, sharing expertise, coordinating strategies, and building a united front to protect fundamental rights and promote accountability in digital surveillance practices.

Strengthening Digital Security Through Robust Vulnerability Management


The SpywareShield Initiative is committed to closing security gaps that enable spyware infiltration. Systemic vulnerabilities in digital infrastructure, expose activists, journalists, and civil society to surveillance abuse. Despite a ruling by the German Federal Constitutional Court requiring proper vulnerability management, Germany has yet to implement these protections.

On 21 July 2021, the Federal Constitutional Court rejected a constitutional complaint by the GFF against the Baden-Württemberg Police Act. What looks like a defeat at first glance is actually a win for us all. The court explained in its reasoning that the state is not allowed to exploit every security loophole for the use of spying software (‘state Trojans’). Rather, it should assess whether a security gap is so dangerous for the public that the state must work towards closing it.

To address the requirement of a proper vulnerability management, we are developing a comprehensive legal framework to ensure that vulnerabilities must be disclosed and patched immediately. Our legal analysis will identify gaps in existing laws and provide actionable recommendations for stronger oversight and accountability. By using Germany as a pilot case, we aim to lay the groundwork for effective vulnerability management at EU level, enhancing the resilience of digital infrastructure across Europe.
