Thanks to more than 18,000 dedicated donors, the Society for Civil Rights (GFF) is able to prepare an expert opinion on the potential unconstitutionality of the AfD. We are conducting a legal analysis based on scientific standards to determine whether a motion to ban the AfD would be successful.

One thing is already clear: many complex questions arise, and we have a great deal of material to review. We therefore cannot yet predict an exact date for the completion of the expert opinion. We expect the work to continue until early summer 2026. Don’t worry: we won’t wait until the end to update you—we’ll also share interim progress reports!

With every additional donation, we can implement additional projects alongside the preparation of the expert opinion—such as regular exchange sessions with academics and practitioners.

If not all of the donations are needed to prepare an expert opinion on the question of the unconstitutionality of the AfD, the GFF will, in accordance with its bylaws, use the remaining funds for other charitable purposes that serve to strengthen democracy and defend fundamental and human rights.

Note regarding donation receipts

The GFF is a recognized nonprofit organization. For donations over 300 euros, we will issue a donation receipt. For this, we need your mailing address. If you use the donation form, please enter your information in the contact fields. If you prefer to make a bank transfer, please include your name and address in the transfer description.

For donations up to 300 euros, a bank transfer receipt is sufficient proof for the tax authorities.

Under certain conditions, unconstitutional parties can be banned in Germany. However, the process of banning a party is subject to high thresholds. To date, there has been no thorough examination of the legal requirements necessary for banning the AfD. The Federal Office for the Protection of the Constitution’s official assessment of the party does not necessarily mean that initiating a ban would be successful.

We are therefore undertaking the task of answering, with scientific and legal expertise: Is the AfD unconstitutional?

If these conditions were met, then—according to the interpretation of the Basic Law—a (bannable) party would pose greater dangers than its ban: In that case, the very foundations that people in Germany absolutely need for their free democratic development on the basis of the Basic Law and fundamental rights would be at stake.
